(فإن كان في بيت الرجل من يقوم مقام امرأته، كجاريته، وأخته، وغلامه المتصرف في بيت سيده وطعامه، فهو كزوجته) يجوز له الصدقة بنحو رغيف من ماله، ما لم يمنع، أو يكن بخيلًا، أو يضطرب عُرف، ويشك في رضاه.
