وإن وكله في بيع عبد بمائة فباع نصفه بها صح وله بيع النصف الآخر

كشاف القناعal-Buhuti

(وإن وكَّله في بيع عبد) أو غيره (بمائة، فباع) الوكيل (نصفه بها) أي: بالمائة (صَحَّ) البيع؛ لأنه حصَّل غرضه، وزاده زيادة تنفعه، ولا تضرُّه (وله) أي: الوكيل (بيع النصف الآخر) لأنه مأذونٌ في بيعه، فأشبه ما لو باع العبدَ كله بمثلي ثمنه.
