(إلا أن يقضيه) الوكيل (بحضرة الموكِّل) فإنه لا يضمن؛ لأن حضوره قرينة رضاه بالدفع بغير بينة (أو) إلا أن (يأذن) الموكِّل (له) أي: للوكيل (في القضاء بغير إشهاد) فلا يضمن؛ لأنه ممتثل، فلا يُنسب إليه تفريط.
