(قال القاضي وغيره) من الأصحاب: (سواء صدَّقه الموكِّل) في القضاء (أو كذَّبه) لأنه إنما أذن في قضاء مبرئ، ولم يوجد (كما لو أمره بالإشهاد، فلم يفعل) أي: يُشهِد، فيضمن لمخالفته
