(إلا أن يدعي) الوكيل (رده، أو تلفه بعد قوله: ما لك عندي شيء) فلا يُسمع قوله، لمنافاته لجوابه، لكن في مسألة التلف يُقبل قوله بيمينه بالنسبة لغرم البدل، كما يأتي في الغاصب.
