(فإن اشتركا في) مال (مختلطٍ بينهما شائعًا) كمال ورثاه، أو اتهباه، ولم يعلما كميته (صحَّ) عقد الشركة (إن علما قَدْرَ مال كلٍّ منهما) فيه من نصف أو ربع ونحوه؛ لانتفاء الغرر بذلك.
