(وإن لم يشرطا عليه) أي: على المشروط له الجزء غير عبد أحدهما (عملًا) مع العامل (لم تصح المضاربة) لأنه شرط فاسد يعود إلى الربح، ففسد به العقد، كما لو شرطا دراهم معلومة.
