وإن اشتراه بأذنه صح أيضا وتنفسخ المضاربة في قدر ثمنه فيهما:

(وإن اشتراه) العامل (بإذنه) أي: إذن ربِّ المال (صح) الشراء (أيضًا) لأنه يصح شراؤه بنفسه، فكذا نائبه، ولا ضمان عليه؛ لأن ربَّ المال هو الآذن في إتلافه. (وتنفسخ المضاربة في قدرِ ثمنِه فيهما) أي: فيما إذا اشتراه بغير إذنه، وفيما إذا اشتراه بإذنه لتلفه.
