(وليس له) أي: المضارب (الشراء من مال المضاربة، إن ظهر) في المضاربة (ربح) لأنه شريك لرب المال فيه (وإلا) بأن لم يظهر رِبح (صحَّ كشراء الوكيل من موكِّله) فيشتري من ربِّ المال أو من نفسه بإذن ربِّ المال.
