(وما يتلف) من الأعيان أو الأجرة (بتعدي أحدهما، أو تفريطه، أو تحت يده على وجه يوجب الضمان عليه) كمنع أو جحود (فهو) أي: التالف (عليه وحده) لانفراده بما يوجب الضمان.
