كشاف القناعal-Buhuti

(ولو عَمِلا في شجر لهما، وهو) أي: الشجر (بينهما نصفان، وشرطا) أي: الشريكان (التفاضلَ في ثمره) بأن قالا: على أن لك الثلث، ولي الثلثين (صح) لأن من شُرط له الثلثان قد يكون أقوى على العمل، وأعلم به ممن شُرط له الثلث.
