(ومِن شَرْطِ صحة المُساقاة تقديرُ نصيب العامل بجُزء) مُشاع (من الثمرة، كالثلث والربع) والخمس؛ لما سبق من أنه - صلى الله عليه وسلم -: "عاملَ أهلَ خَيبرَ بِشَطْر ما يخرجُ مِنْ ثمرٍ أو زرعٍ".
