(وإن نقصت) الثمرة بذلك (فله) أخذُها و (أرشُ نقصِها، ويرجع به على من شاء منهما) أي: الغاصب والعامل (ويَستقرُّ الضمان على الغاصب) لأنه سبب يد العامل.
