(فإن شرط) في مساقاة، أو مزارعة (على أحدهما) أي: المالك, أو العامل (ما يلزم الآخرَ، أو بعضَه، فَسَد الشرطُ والعقدُ) لأنه شرطٌ يخالف مقتضى العقد فأفسده، كالمضاربة، إذا شرط العمل فيها على ربِّ المال.
