(ولا يصح استئجار دابة بعلفِها، أو بأجر مُعين وعلفها) لأنه مجهول، ولا عُرْفَ له يرجع إليه (إلا أن يشترطه) أي: العلف (موصوفًا) كشعير ونحوه، وقَدْره بمعلوم، فيجوز.
