(ولا) تصح (إجارة مُشاعٍ مفرَد لغير شريكه؛ لأنه) أي: المؤجر (لا يقدر على تسليمه) إلا بتسليم نصيب شريكه، ولا ولاية عليه؛ فلم يصح، كالمغصوب.
