(ما لم يكن المأجور حرًّا، كبيرًا) كان (أو صغيرًا) ، خلافًا "للتنقيح" حيث قَيَّد بالكبير (فإنه ليس لمستأجره أن يؤجره؛ لأنه لا تثبت يدُ غيره عليه، وإنما هو يسلِّم نفسه) إن كان كبيرًا (أو يسلِّمه وليُّه) إن كان صغيرًا.
