(وله) أي: المستأجر (على المالك أجرة المِثْل لما سكنه، أو تصرَّف فيه) لأنه تصرَّف فيما ملكه المستأجر عليه بغير إذنه، فأشبه تصرُّفه في المبيع بعد قبض المشتري له، وقبضُ العين هنا قامَ مقام قبض المنافع.
