(فأما إن شردت الدابة، أو تعذَّر استيفاء المنفعة بغير فعل المؤجر، فله) أي: المؤجر (من الأجر بقَدْرِ ما استوفى) المستأجر (بكل حال) سواء عادت العين في المدَّة، أو لم تعد؛ لأن للمكري فيه عذرًا.
