(ومتى زَرَعَ؛ فغرِق) الزرع (أو تلِف) الزرع (بحريقٍ، أو جراد، أو فأر، أو بَرْد، أو غيره قبل حصاده، أو لم تُنبت، فلا خيار، وتلزمه الأجرة، نصًّا (١) ) لأن التالف غيرُ المعقود عليه، وسببه غير مضمون على المؤجر
