(وإن كانت) الإجارة (على عين معينة لعمل) بأن أجره هذه الدابة ليركبها إلى كذا، أو هذه الأمَة لتخيط له ثوبًا معلومًا، فغُصِبت (خُيِّر مستأجر بين فسخ، وصَبْرٍ إلى أن يقدِرَ عليها) لأن الحق في ذلك له، فإذا أخَّره، جاز.
