(ولو أتلف المستأجر العين) المؤجرة (ثبت ما تقدم من) ملك (الفسخ) إذا كانت على موصوفة في الذمة وتعذَّر البدل (أو الانفساخ) إذا كانت على معينة؛ لتعذُّر تسليم المعقود عليه (مع تضمينه) أي: المستأجر (ما أتلف) من العين.
