(وإن كانت الإجارة على عَينهِ في مدة، أو غيرها) بأن استأجر عبدًا معينًا، أو إنسانًا معينًا ليخيط له شهرًا، أو ليبني له هذا الحائط (فمرض) الأجير (لم يقم غيرُه مقامَه) لوقوع العقد على عينه، كالمبيع المعين.
