(ولا أجرة له) أي: الأجير المشترك (فيما عمله) وتلف قبل تسليمه لربه (سواء عمله في بيت المستأجر، أو) في (بيته) لأنه لم يُسلِّم عمله للمستأجر، فلم يستحق عوضه، كالمبيع من الطعام، إذا تلف في يد بائعه. لكن كلام "المنتهى" الآتي في الفصل بعده يخالفه.
