وإن حبس الصانع الثوب على أجرته بعد عمله فتلف أو أتلفه أو عمل على غير صفة شرطه ضمنه

كشاف القناعal-Buhuti

(وإن حبس الصانع الثوب على أجرته بعد عمله) أي: قَصره، أو خياطته، أو صبغه، ونحوه (فتلف) ضمنه؛ لأنه لم يَرهنه عنده، ولا أذن له في إمساكه؛ فلزمه الضمان كالغاصب (أو أتلفه) أي: أتلف الصانع الثوبَ بعد عمله، ضمنه (أو عمل) الصانع (على غير صفة شرطه) أي: ربّ الثوب (ضَمِنه) الصانع لجنايته
