(وإن لم يتسلَّم) العين في الإجارة الفاسدة (لم يلزمه أجرة، ولو بذلها) أي: العين (المالك) لأن المنافع لم تتلف تحت يده، والعقد الفاسد لا أثر له، بخلاف الإجارة الصحيحة.
