كشاف القناعal-Buhuti

(وكلُّ ما تعيَّن (١) لا يجوز إبداله، كالمتعين في البيع، وما لا يتعيَّن يجوز إبداله لعُذر وغيره) فإن شرط ألَّا يرمي بغير هذا القوس، أو بغير هذا السهم، أو لا يركب غير هذا الراكب، فهو فاسد؛ لأنه ينافي مقتضى العقد.
