(ولا يلزمه) أي: المُستعير (تسويةُ الأرض) إذا حصل فيها حفر (إلا بشرط) المعير عليه ذلك؛ لرضاه بذلك، حيث لم يشترطه على المستعير فإن شرطه عليه، لزمه؛ لدخوله على ذلك.
