(وإن حمل) السيل (غرسًا) إلى أرض آخر، فنبت فيها (فكغرسِ مشترٍ شِقْصًا فيه شفعة) إذا أخذه الشفيع، فلربِّ الأرض أن يتملكه بقيمته أو يقلعه، ويضمن نقصه كالشفيع، وليس له قَلعه مجانًا؛ لأنه لم يحصُل مِن ربِّه عدوان فيه.
