(وكل ما كان أمانةً) لا يزول عن حكمه بشرط ضمانه، كالوديعة والرهن (أو) كان (مضمونًا لا يزول عن حكمه بالشرط) لأن شَرْطَ خلاف مقتضى العقد فاسدٌ.
