(وإن كان) استعار كُتُبِ العلم الموقوفة ونحوها (بِرَهْن) وتلفت (رجع) الرهن (إلى ربه) وعلى ما تقدم في الرهن: لا يصح أخذ الرهن عليها؛ لأنها أمانة، فيرد الرهن لربه مطلقًا وإن فرَّط لفساده، ويضمن المستعير ما تلف منها بتفريطه أو تعديه.
