(ولا يَضمن الغاصب مهرها، لو حبسها عن النكاح حتى فات) نكاحها (بالكبر) أي: كبرها؛ لأن النفع إنما يضمن بالتفويت، إذا كان مما تصح المعاوضة عليه بالإجارة، والبُضع ليس كذلك.
