(وإن أتلف) غاصب، أو غيره (الكلبَ، أو الخمر -ولو كان المتلِفُ ذميًّا- لم تلزمه قيمتهما) لأنهما ليس لهما عوض شرعي؛ لأنه لا يجوز بيعهما (كخنزير، و) كـ ( خمر غير مستورة) ولو لذمي.
