(العبد، وإن منعه) أي: منع إنسانٌ آخر (العملَ من غير حبس، فلا) ضمان عليه في منافعه (ولو) كان الممنوع (عبدًا) لأن منافعه فاتت تحت يده، فلا يضمنها الغير.
