(وإن كان حصوله) أي: الفصيل (في الدَّار من غير تفريط من صاحبها) بأن دخل الفصيل بنفسه، أو أدخله ربه (نُقضَ الباب، وضمانه على صاحب الفَصيل) لأنه لتحصيل مالِه، فيغرم مالكه أرش نقض البناء وإصلاحه.
