(وإن رماه) إنسان (فقتله، ضَمِنه) الرامي (وإن كان في داره) لأنه كان يمكن تنفيره بغير قتله. (وإن قتله) أي: الطائر (وهو مار في هواء داره، أو) وهو مار في (هواء دار غيره، ضَمِنه) لأنه لا يملك منع الطائر في الهواء.
