(وإن تَرَك وليٌّ - ولو) كان (أبًا - شفعةَ موليهِ، صغيرًا كان أو مجنونًا) أو سفيهًا (لم تسقط) شُفعته؛ لأن الترك من غيرِ الشفيع كالغائب إذا ترك وكيله الأخذ بها.
