(وإن أَذِنَ) الشريكُ لشريكه (في البيع، أو أسقَطَ) الشريكُ (شُفعته قَبْل البيع، لم تسقُطْ) شُفعته؛ لأنه إسقاط حق قبل وجوبه، فلما يسقط، كما لو أبرأه مما سيقرضه له.
