(وإن أفلس الشفيع) بعد الأخذ بالشُّفعة (والثمن) كلُّه (في الذِّمة) أي ذمة الشفيع (خُيِّر مشترٍ بين فسخ) الأخذ بالشفعة (و) بين (ضَرْبٍ مع الغرماء بالثمن، كبائع) مع مشتر أفلس؛ لحديث:"مَنْ أدْركَ متاعَه عند مَنْ أفْلسَ فهو أحق به" وتقدم في الحجر .
