(إلا إذا أقرَّ البائع وحدَه بالبيع) وأنكر المشتري الشراءَ، وأخذ الشفيع الشِّقص من البائع (فالعُهدَة عليه) أي: على البائع؛ لحصول الملك للشَّفيع من جهته؛ قاله الزركشي. والعمدة في الأصل: كتاب الشراء
