(فإن آذاه) بالدخول، فله منعه،

وكذا لو تضرَّرَ ببَذْلِهِ، أو وجد مباحًا غيره (أو كان له فيه) أي: البئر (ماء السماء، فيخاف عطشًا، فلا بأس أن يمنعه) لأنه ملكه بالحِيازة، فلم يلزمه بذله كسائر أملاكه، بخلاف العِدِّ.
