(ومن أخذ الآبق، أو) أخذ (غيره) من المال الضائع، ليوده لربِّه (فهو أمانة في يده، إن تلف) قبل التمكُّن من رَدِّه (بغير تفريط) ولا تعدٍّ (فلا ضمان عليه) فيه؛ لأنه محسن بأخذه.
