(ومتى أخذها) أي: أخذ الملتقط اللقطة (ثم ردها إلى موضعها) ضمنها (أو فرَّط فيها) فتلفت (ضَمِنها) لأنها أمانة حصلت في يده، فلزمه حفظها كسائر الأمانات، وتركُها والتفريط فيها تضييع لها
