(ويرجع) الملتقِط (به) أي: بما أنفقه على الحيوان (ما لم يتعدَّ) بأن التقطه؛ لا ليعرِّفه، أو بنية تملّكه في الحال ونحوه (إن نوى الرجوعَ) على مالكه - إن وجده - بما أنفق، كالوديعة (وإلا) بأن أنفق ولم ينوِ الرجوع (فلا) رجوع له بما أنفق؛ لأنه متبرِّع.
