ولو قال مالكها بعد تلفها: أخذتها لتذهب بها وقال الملتقط بل لأعرفها فقوله مع يمينه

(ولو قال مالكها) أي: اللقطة (بعد تلفها) في حول التعريف بلا تفريط (أخَذْتَها لتَذْهب بها) لا لتعرِّفها، فأنت ضامن (وقال الملتقِط: بل) أخذتُها (لأُعَرِّفها، فقوله) أي: الملتقِط (مع يمينه) لأنه منكِرٌ، والأصل براءته.
