(وإن وجدَها) أي: اللُّقطة (صغيرٌ، أو سفيهٌ، أو مجنونٌ) صَحَّ التقاطه؛ لأنه نوع تكسُّب كالاصطياد، و (قام وليُّه بتعريفها) لأنه قد ثبت لواجدها حق التملك فيها، فكان على وليه القيام بها
