(والمستحبُّ) لواجد اللقيط الإنفاق (بإذنه) أي: الحاكم (إنْ وُجِد) لأنه أبعد من التهمة، وأقطع من الظنة ، وفيه خروج من الخلاف، وحفظ لماله من أن يرجع عليه بما أنفق.
