(اليتيم، فإن بلغ اللقيط، واختلفا) أي: اللقيط وواجده (في قَدْر ما أنْفق) واجده عليه، فقول المتفق بيمينه (أو) اختلفا (في التفريط في الإنفاق) بأن قال اللقيط: أنفقت فوق المعروف، وأنكره واجده (فقول المنفق) بيمينه؛ لأنه أمين، والأصل براءته.
