(فإن فَضَّل) الواقفُ (بعضَهم على بعض، أو خصَّ بعضَهم بالوقف دون بعض، فإن كان على طريق الأثَرة) بأن لم يكن لغرض شرعي (كُرِه) لأنه يؤدِّي إلى التقاطع بينهم
