(وإذا أوصى بعِتق عبدِه) المعيَّن، وخرج من الثلث (لزم الوارث إعتاقه) لصحة الوصية، ولزوم الوفاء بها، ولا يعتق قبل إعتاقه (ويجبره الحاكم عليه) أي: إعتاقه (إنْ أبى) أن يعتقه كسائر الحقوق عليه
